1. Acceptance of Terms
By accessing or using PromptMotion(the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, registered users, and anyone who accesses or uses the Service.
2. Description of Service
PromptMotion is an AI-powered video prompt generation tool that helps users create optimized prompts for AI video models including Seedance, Kling, and others.
Independent Product Disclaimer
PromptMotionis an independent product and is not affiliated with, endorsed by, or sponsored by ByteDance Ltd. or its subsidiaries. “Seedance” is a trademark of ByteDance Ltd. References to “Seedance” on this platform are solely descriptive, referring to the AI video model for which our tool generates prompts.
3. Eligibility
- You must be at least 13 years old to create an account and use the Service.
- You must be at least 18 years old to make any purchases (credit packs or subscriptions).
- If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
- The Service is not available to persons previously suspended or removed from the Service.
4. Account Registration & Security
You must provide an accurate email address when registering. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use at support@seedancetool.com
You may not share your account credentials or allow others to access your account. Each account is for a single user only.
5. Acceptable Use
By using the Service, you agree to comply with our Acceptable Use Policy. The following are strictly prohibited:
Prohibited Content
- Sexually explicit, pornographic, or NSFW content of any kind
- Content depicting or sexualizing minors
- Non-consensual intimate imagery or deepfake content of real individuals
- Content promoting or glorifying violence, self-harm, or terrorism
- Hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Content that infringes third-party intellectual property rights
- Deceptive, fraudulent, or misleading content
Prohibited Activities
- Attempting to bypass, circumvent, or disable content filters or safety measures
- Reverse engineering, decompiling, scraping, or bulk-querying the Service
- Sharing account credentials or reselling access to the Service
- Using outputs to train competing AI models without our prior written permission
- Any use that violates applicable local, national, or international law
Violations may result in immediate account suspension and forfeiture of unused credits without refund. See the full Acceptable Use Policy for details.
6. Credits & Subscriptions
- Free tier: Free users receive a daily credit quota for prompt generation. This quota resets at midnight UTC.
- Credit packs: Purchased credits do not expire. Credits are consumed per generation. Credit balances are non-transferable.
- Subscriptions: Pro subscriptions renew automatically on a monthly basis unless cancelled before the renewal date. You can cancel anytime via your billing dashboard.
- Credits and subscription benefits are tied to your account and cannot be transferred to another account.
7. Payment Processing
All payments on PromptMotion are processed by Creem (creem.io). Creem acts as the Merchant of Record (MoR) for all transactions, meaning Creem is responsible for:
- Processing your payment and issuing receipts
- Collecting applicable taxes (VAT, GST, sales tax) based on your location
- Managing billing disputes and chargebacks
By completing a purchase, you also agree to Creem's Terms of Service and Privacy Policy.
8. Refunds
Our refund terms are set out in our Refund Policy. New subscribers may request a full refund within 7 days of their initial purchase. For credit packs, unused credits are refundable within 7 days if fewer than 20% have been used. Refunds are processed through Creem.
9. Intellectual Property
The Service, including its software, design, and content (excluding user inputs), is owned by PromptMotion and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without written permission.
Your prompts: You retain ownership of the text inputs you provide to the Service. You grant PromptMotion a limited, non-exclusive license to process your inputs solely to provide the Service. We do not claim ownership of or rights to your generated prompts.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE RESULTS SUITABLE FOR ANY PARTICULAR PURPOSE. USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROMPTMOTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.
12. Indemnification
You agree to indemnify and hold harmless PromptMotion and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that:
- You have violated these Terms or our Acceptable Use Policy
- Your use of the Service poses a risk to us, other users, or third parties
- Required by applicable law
Upon termination for cause, unused credits are forfeited and are not eligible for a refund. You may terminate your account at any time by contacting support@seedancetool.com.
14. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes by email or by posting a notice on the Service. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms will be resolved through good-faith negotiation first. If negotiation fails, disputes will be submitted to binding arbitration or resolved in courts of competent jurisdiction.
